Gay Sex in PUBLIC Park Protected by Calif. Judge

FRESNO, CA:
"Storyland" isn't what it used to be.
Men ages 25 to 70 were seen masturbating and having oral sex in
three of (a park's) six bathrooms. Sex acts occurred outside stalls
and involved multiple men over a period of six months, authorities
said. 40 men have been arrested for lewd and lascivious behavior and
having gay sex in a public park, one location known as "Storytime,"
reported The Fresno Bee on March 13.
After careful completion and presentation of evidence, California Judge James Quashnick has
ruled that the charges
may be dismissed against the men because no heterosexuals were
involved, claiming this constitutes discrimination!
The next court hearing is scheduled for early in April.
Deputy Aaron Kilner, 27, was killed
in an off-duty motorcycle accident in August. Kilner was the lone
witness in the case against Richard Thomas Newkirk, 55, who was
arrested Oct. 3, 2002, for lewd and lascivious conduct in public and
loitering around a public toilet for such activity.
Kilner was killed when the motorcycle he was riding crashed into a
car at an intersection, making him the fourth member of the
department in two years to meet a violent death. He was a key witness
in many other cases.
Appearing in a heated debate on Bill O'Reilly on March 16 was Bruce
Nickerson, a criminal defense attorney representing many of the men
charged. Nickerson argued that heteros are guilty of similar acts
including "touching each other's buttocks."
After pressed questioning by O'Reilly, Nickerson admitted that in most
cases the heteros were "fully clothed."
Nickerson vehemently insisted that it is not illegal in California
to perform sex in public stalls, and if a witness peers over or under
the stall, then they have broken that person's privacy rights and
cannot file a complaint.
Are California judiciaries insane? Do they realize that MOMS CANNOT
ACCOMPANY THEIR YOUNG SONS INTO MEN'S BATHROOMS?
There comes an age when a young boy is uncomfortable going into the
women's restroom. And women are sometimes uncomfortable sharing
facilities with 5 year old boys, so moms will nervously allow their
young sons into the Men's side.
Are California liberal judges so perverse as to set up the system
for young boys to be molested, legalizing sex in public bathroom
stalls?
At the close of O'Reilly's interview, Nickerson began naming off
a long list of counties ALL OVER
CALIFORNIA where he is representing clients in similar cases.
